TERMS AND CONDITIONS

The following terms and conditions apply to all transactions with Total Web Creations. By making an enquiry/placing an order with Total Web Creations indicates that you agree with the terms and conditions set out below.


Scope
This agreement shall apply to all goods and/or services ordered by the client from Total Web Creations.


Prices
Any prices shown on the website are in UK pounds sterling. They are subject to change without prior notice. The price of orders previously confirmed will not be affected by any changes.

An ‘order’ is deemed to be a written or verbal contract between Total Web Creations and the client; this includes telephone and email agreements. However, orders must be confirmed in writing, either via email, text or post.


Browser Compatibility
We endeavour to ensure that all websites created will display as desired in most web browsers. However we offer no guarantees of correct function with all browser software. If any discrepancies are discovered then please notify Total Web Creations.


SEO

Whilst every effort is made using organic search engine optimisation to rank a website as highly as possible on search engines, Total Web Creations cannot guarantee a client’s website ranking position.

If the client wishes to enhance their ranking position, other options can be explored, such as Google Adwords.


Proofing

Every endeavour is made by Total Web Creations to ensure that all work carried out is correct. Proofing and checks are undertaken by Total Web Creations. However, ultimately it is the client’s responsibility to proof check their artwork and provide written sign off via email to Total Web Creations as such.

Total Web Creations cannot take responsibility for any copyright infringements caused by materials supplied by the client. The client is 100% responsible for obtaining permission for use of any intellectual property, copyrighted and trademarked materials, licensed agreements, images and text supplied (or obtained by Total Web Creations on the client’s behalf) for print use.

A written verification is required for the approval of artwork to go to print, typically via email in response to the artwork proof sent.

It is agreed that Total Web Creations is not responsible or to be held liable for any errors with the final artwork, after it has been approved by the client and sent to print. It is the sole responsibility of the client to notify Total Web Creations of any such errors during the final proofing stage. If any alterations are identified by the client after sign off and the artwork has been printed, re-print costs will be incurred by the client and not Total Web Creations.

There may be some colour variation between the artwork proof seen on a computer or mobile device screen and the final physical printed job.


Advice and Guidance

Total Web Creations gives advice with regards to developing a project strategy in good faith. Guidance is provided using knowledge and expertise gathered through many years of working with website, design and print projects. Total Web Creations works closely with clients to ensure they are 100% happy with project strategy before moving forward with any work.


Loss of Data
Total Web Creations does not accept responsibility for loss of data. Website backups are taken quarterly (or as per order/agreement) to help prevent this from happening. Files are kept in multiple locations to avoid all accessible data becoming corrupted. It is the client’s responsibility to backup emails, contacts and other such information stored via any webmail or ftp facilities.


Data Protection
We take steps to make our service as secure as possible, including keeping content management systems and plugins up-to-date. However, please do note that we cannot guarantee 100% security of your data.


Payment
Payments are made as agreed upon by Total Web Creations and the client. Normal practice is for a deposit of 25% to be taken before a project commences; the balance is due upon completion of the work as agreed. This excludes (but not limited to) ‘Website for £350’, the amount of which is payable for up front before work is carried out.

Payment can be made either by direct transfer into Total Web Creations business bank account, online via Paypal (subject to a 3.4% fee), cheque (cheques should be made payable to Total Web Creations), or cash (in person).

Unless an alternative payment date is agreed upon between Total Web Creations and the client, an invoice is payable within 30 days of the client receiving the invoice. A reminder will be sent after 30 days. If an amount remains unpaid 60 days after it’s due date, an additional 10% penalty will be added for each month of delinquency.

Additional design work undertaken at Total Web Creations is charged at an hourly rate of £25.


Copyright
Total Web Creations cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material. Any web page, design or entire site created by Total Web Creations carries a copyright and cannot be reproduced without written consent.
